(Eric Nelson) – Recently, Nevada News & View articles revealed the dangerous leniency of Las Vegas judge Bita Yeager (go to article), the woke defiance of law and the Nevada Supreme Court by socialist Judge Erika Ballout (go to article), and described how the MacArthur Foundation is funding no-cash bail and other release programs (go to article).
There are other judicial problems in Nevada.
Recently all 176 applications for a temporary protective order (TPO) decided by Justice of the Peace “X” in 2024 were reviewed.
The error rate was 26.1%.
In 12.5% of the cases, applicants seeking protection described all the elements of at least one crime, and therefore a TPO should have been issued–but was not.
They needed protection and didn’t get it.
In 13.6% of the cases applicants failed to describe all of the elements of at least one crime, yet, a TPO was issued.
Innocent people who did not break the law nevertheless were hit with the stigma, risks, and restrictions of a TPO.
Justice of the Peace X denies TPO’s significantly more often when a man seeks protection from a woman, compared to a woman seeking protection from a man.
This remains true even when only non-violent cases are examined.
In one case Justice of the Peace X said, “[I]t would probably be a good idea to… separate all parties”.
Sounds good, but that is not lawful.
The law does not give a Judge or Justice of the Peace the authority to issue a TPO unless the applicant has described all of the elements of at least one of seven specific crimes.
The Nevada Supreme Court rebuked Justice of the Peace X in a prior case, stating no judge can create new law–that is the job of the Nevada legislature.
Activist judges have twisted the law to harm President Trump, the J6’rs, and innumerable conservatives, while at the same time favoring criminals, illegal aliens, and anti-American leftists.
Judicial harm isn’t limited to politics, as assessment of Justice of the Peace X demonstrates.
Bad judging can exist at all levels of the judiciary.
In Nevada investigation and punishment of errors and mistakes by Judges or Justices of the Peace is mostly concealed from public view by the Nevada Commission on Judicial Discipline.
The equivalent organization in California operated for 56 years before it was first audited by the legislature in 2019.
The California State Auditor found weak oversight that enabled persistent judicial misconduct, concluding “operations and structures must change significantly” (report here).
That might be true here in Nevada. A search of the Nevada Legislature’s audit reports shows none for the Nevada Commission on Judicial Discipline.
It is time for the Nevada legislature to audit the Nevada Commission on Judicial Discipline, to find out how often rogue jurists are properly investigated and properly and effectively disciplined–or not.
