Thomas and Alito Were Right – The 14th Amendment Got Twisted for Politics
The Supreme Court had a chance today to fix one of the biggest scams in American immigration policy.
They blew it.
Even with President Trump's executive order trying to shut the door, the justices ruled that kids born here to parents who are here illegally still get automatic citizenship.
No questions asked. No allegiance required. Just show up, have the baby, and walk away with a U.S. passport for your child.
That's not how this was supposed to work.
Thomas Knew the History – The Majority Didn't Care.
Justice Clarence Thomas wrote a sharp dissent, joined by Justice Neil Gorsuch.
He laid out the real story behind the 14th Amendment. It was written after the Civil War for one reason: to make sure freed slaves and their children became full citizens.
These were people with deep roots in this country. Nobody else claimed them. Their allegiance was here, period.
Thomas didn't mince words.
The Court has twisted the amendment into something its authors never intended. It's being used today to chase modern political goals instead of solving the problem it was written to solve.
Alito Called It What It Is: A Mistake
Justice Samuel Alito went even further.
He called the ruling a serious mistake, one that hands citizenship to nearly anyone born on U.S. soil, including the children of “birth tourists.”
You know the playbook. Fly in just long enough to deliver the baby, then fly home with a brand-new American citizen in your arms.
Alito argued the amendment was only ever meant to cover children who owe their full allegiance to America the moment they're born. Not kids whose parents are tied to another country the whole time.
Critics will tell you this is how it's always worked, so why touch it now. They'll point to old case law and call any change unfair.
But the dissenters showed exactly what the original words meant.
“Subject to the jurisdiction thereof” meant owing complete allegiance to the United States. Not just standing on American dirt when labor starts.
Only One Fix Actually Sticks
An executive order can get blocked by a court, like this one just was.
A regular law can get rewritten by the next Congress that comes along.
The only fix that actually locks in for good is a constitutional amendment.
That amendment would say what should've been obvious all along: citizenship at birth requires at least one parent who is a U.S. citizen or lawful permanent resident.
That protects the promise for real Americans and slams the door on the loophole that keeps pulling in illegal immigration.
Congress proposes it. The states ratify it. That's how we the people take the power back from judges who keep stretching four words to mean whatever they want them to mean.
The dissenters did their job. They laid out the case plain and simple, with the history and the law on their side.
