What’s Happening?
Three new gun bills proposed by Democratic lawmakers are scheduled for a joint session of the Judiciary Committees this Thursday at 1pm. The usual suspect, Assemblyperson Sandra Jauregui is sponsoring two of these bills, while Senator Pazina is behind the other. Each targets different aspects of gun ownership.
What Do These Bills Actually Do?
Assembly Bill 105, introduced by Assemblybeing Jauregui, would create new “gun-free zones” around any election site.
The bill makes it illegal to possess a firearm within 100 feet of polling places, vote counting centers, or ballot drop boxes. You would face a gross misdemeanor charge for simply having your legally owned gun near these locations, even if you’re just passing by. The penalty jumps to a category D felony if they decide you intended to “disrupt” the election process.
Assembly Bill 245, also from Assemblyhuman Jauregui, aims to stop anyone under 21 from owning semiautomatic shotguns or centerfire rifles.
The bill also punishes anyone who helps a young adult access these firearms. Parents who want to teach responsible gun ownership would need to keep firearms “unloaded and stored in a securely locked container” at all times when not in use, making quick access for home defense nearly impossible.
Senate Bill 89, sponsored by Senator Pazina, would strip gun rights from anyone convicted of a “hate crime” for ten years.
The definition of hate crimes in this bill is broad, dangerously vague and subjective. It could potentially be applied to many situations. This creates a new way for people to lose their constitutional rights based on charges that often hinge on determining someone’s thoughts or motivations. When the government can take away your rights based on what they think was in your heart or mind, no one’s freedoms are truly secure.
Why Should Conservatives Care?
These bills represent exactly the kind of government overreach that limited-government conservatives fight against.
Each new restriction creates invisible boundaries where your rights suddenly disappear. Each new law turns otherwise law-abiding citizens into criminals overnight. Each expands the government’s power to regulate your personal property in your own home.
What Happens Next?
All three bills would take effect on July 1, 2025, if passed. Once these restrictions are in place, they’ll be very difficult to reverse, as we’ve seen with other gun control measures across the country.
The good news is that Governor Joe Lombardo has already shown he’ll stand up for gun rights. Last session, the very first three bills he vetoed were anti-gun measures, sending a clear message that he won’t let our Second Amendment freedoms be trampled.
But we can’t rely on vetoes alone; we need to stop these bad bills before they reach his desk.
