No constitutional authority for e-verify

(Durk Pearson) – Rep. Joe Heck is well intentioned on immigration reform, but he hasn’t thought through the extremely dangerous long term implications of his position.

Where does the US Constitution give the central government the authority to demand under penalty of law that no-one be allowed to offer anyone a job without the Federal government’s prior permission? The Commerce Clause?

If the Commerce Clause has that long a reach, the Federal goverView Postnment could require that everyone obtain its prior permission befor wiping their asses because their toilet paper moved in interstate commerce.

There is no Constitutional authority for the central government to demand that everyone have a biometric Federal ID card in order to be able to work, or to obtain prior permission from them via E-Verify. That is Stalinism on stilts.

When a government controls whether or not one can work, they have everyone in a literal stranglehold. Oh, the central government would never abuse those powers? Do you believe in the tooth fairy, too? Besides, I thought that the people of Nevada (and those of most other States) had rejected the Real ID Federal drivers license mandate.

What is my suggested alternative? It is simple and Constitutional:

Require a Federal biometric ID card – or E-Verify permission – to obtain any type of Federally funded welfare – including food stamps, Medicaid, WIC, SCHIP – everything. The Constitution does allow the central government to demand that people identify themselves to its satisfaction before giving them money or goods.

Of course, the Democrats will be dead set against this. They will oppose any requirement for biometric ID or E-Verify proving that one is a citizen in order to receive welfare paid for by Federal taxpayers, but are all in favor of requiring Federal biometric ID in order to work for a living. Those Democrats have interesting priorities and values, eh?

IT IS SHAMEFUL AND FRIGHTENING THAT THERE ARE PEOPLE WHO CALL THEMSELVES REPUBLICANS WHO THINK THAT IT IS A GOOD IDEA TO REQUIRE THAT EMPLOYERS OBTAIN FEDERAL PERMISSION BEFORE HIRING ANYONE.

Doesn’t my approach mean that illegals will be able to continue to work for a living? Yes.

Does it give them access to welfare? No.

Does it give them a road to citizenship and the vote? No.

Most of the illegal aliens in the US are good people who came here to work for a living – just like your ancestors and mine. That is good, not bad. Most of them didn’t come here to collect welfare, though some will take it if is offered. None of them came here so that they could vote for Democrats, though the Democrats sure want to change that.
