Supreme Court Puts an End to “Choose Your Own Gender” Passports

The Supreme Court just ruled that when it comes to passports, biology beats ideology.

On Thursday, November 6, 2025, the Court gave the green light for President Trump’s administration to enforce a simple rule: your passport has to list the sex you were born as – male or female. Period.

The unsigned order temporarily reverses a lower court that had blocked the policy earlier this year.

That means, at least for now, the U.S. State Department can once again reject applications listing a different gender or a non-binary marker.

The Court’s majority wrote that putting someone’s sex at birth on a passport “no more offends equal protection principles than listing their country of birth.”

In other words, it’s a biological fact, not a social statement.

A Return to Common Sense

This all started after the Biden administration let people pick whatever gender marker they wanted on federal documents – including an “X” for “non-binary.”

That lasted until President Trump took office again in January and signed Executive Order 14168, directing all federal agencies to use only biological sex (male or female) on government paperwork.

It didn’t take long for the lawsuits to start.

A federal judge in Massachusetts blocked the policy in June, calling it “likely unconstitutional.”

But this week, the Supreme Court stepped in and hit pause on that injunction – allowing Trump’s policy to move forward while the case plays out.

It’s not the final word, but it’s a major win for those of us who think government documents should reflect facts, not feelings.

Why It Matters

Passports are international ID.

When you hand one to an immigration officer in another country, they need to know exactly who you are – and that information better match your other records.

Nevada might be a long way from D.C., but the ruling could still have ripple effects.

State officials have already debated gender markers on birth certificates and driver’s licenses.

If federal law says sex means biological sex, it’s only a matter of time before state rules come under pressure to line up.

Predictable Meltdowns from the Activist Crowd

The ACLU called the ruling “a cruel attack on transgender Americans.”

Justice Ketanji Brown Jackson said the decision “inflicts immediate injury without justification.”

But supporters say the government isn’t “erasing” anyone’s identity.

It’s just saying that official documents are supposed to record facts, not personal preferences.

You can call yourself whatever you want – but your passport isn’t a feelings journal.

A Step Toward Sanity

For conservatives, this ruling isn’t about discrimination. It’s about restoring sanity in how government operates.

If your gender can be changed with a checkbox, what’s next? Could we start changing our date of birth because we “identify” as younger?

The Supreme Court didn’t close the book on this issue, but it just turned a very important page.
